This is in response to the Examiner's letter of June 6, 2013.

On behalf of the Applicant, we enclose a revised application wherein a claim to use and eventual registration abroad has been added based on the Applicant's corresponding Chinese application, No. 11792223.

1. The applicant, Triangle Tyre Co., Ltd. the full post office address of whose principal office or place of business is No.56 Qingdao Middle Road, Weihai, Shandong, P.R., CHINA, applies for the registration, in accordance with the provisions of the Trade-marks Act, of the trade-mark identified below.

3. An application to register the trade-mark has been filed by the applicant in or for CHINA the country of origin of the applicant. The application was filed in CHINA on November 23, 2012 under No(s). 11792223 in association with bicycles, bicycle tires; retread tire tread; the pneumatic tire; vehicles with solid tires; tyre (vehicle used); fill tube with adhesive patch; car tires; aircraft tires; fill tube with a set of tools; vehicle tires. The applicant has used the trade-mark in association with (2) bicycle tires; pneumatic tires; used vehicle tires; car tires; aircraft tires; vehicle tires in CHINA. The applicant requests registration of the trade-mark, upon its registration in the country of origin, in respect of the wares in association with which the trade-mark has been used as aforesaid and which are covered by such registration in the country of origin.

4. The applicant by itself or through a licensee, or by itself and through a licensee, intends to use the trade-mark in Canada in association with (1) tires and requests registration of the trade-mark in respect of such wares.

5. The applicant appoints BERESKIN & PARR LLP/ S.E.N.C.R.L., s.r.l., whose full post office address in Canada is SCOTIA PLAZA, 40 KING STREET WEST, 40th FLOOR, TORONTO, ONTARIO, CANADA, M5H 3Y2, as the person (firm or any member of the said firm), as its agent to prosecute this revised application with full powers of amendment and substitution, to execute any amendment related thereto as well as any amended revised application, and to represent the applicant with respect to this revised application, the said agents being authorized to receive the registration certificate on behalf of the applicant.

6. The applicant appoints BERESKIN & PARR LLP/ S.E.N.C.R.L., s.r.l., whose full post office address in Canada is SCOTIA PLAZA, 40 KING STREET WEST, 40th FLOOR, TORONTO, ONTARIO, CANADA, M5H 3Y2 as the person (or firm) to whom any notice in respect of the revised application or registration may be sent, and upon whom service of any proceedings in respect of the revised application or registration may be given or served with the same effect as if they had been given to or served upon the applicant or registrant.

7. The applicant is satisfied that it is entitled to use the trade-mark in Canada in association with the wares described above.
